These Terms of Service ("Terms") govern your use of the Speakery Pro mobile application ("the App") operated by Drizzling Bytes ("we", "us", or "our"). By downloading or using the App, you agree to these Terms.

1. Description of Service

Speakery Pro is a language learning application that helps you practice speaking in 11 languages through conversation scenes, accent training, and vocabulary exercises. The App uses cloud-based language processing services to generate conversation responses and realistic character voices.

2. Eligibility

The App is available to users of all ages. No account creation is required. If you are under 18, you should review these Terms with a parent or guardian.

3. Subscriptions and Payments

• Speakery Pro offers a free tier with limited features and a premium subscription that unlocks all content.
• Subscriptions are billed through your Apple ID account via the App Store.
• Payment is charged at confirmation of purchase.
• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period.
• You can manage or cancel your subscription in your App Store account settings.
• Refunds are handled by Apple in accordance with their App Store terms. By using the App, you also agree to the Apple Standard End User License Agreement (EULA).

4. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose
• Submit custom scene descriptions or feedback containing harmful, abusive, or inappropriate content
• Attempt to reverse-engineer, decompile, or extract source code from the App
• Interfere with or disrupt the App's services or servers
• Use the App to generate content that violates any third-party rights

We reserve the right to block or filter content submitted through the custom scene feature that violates these guidelines.

5. Content and Accuracy

• The App generates conversation responses and translations using cloud-based language processing. While we strive for accuracy, generated content may contain errors or unexpected responses.
• If you encounter any offensive or inappropriate content generated by the AI, please report it immediately to spro@drizzlingbytes.com.
• The App is a learning aid and should not be relied upon as a sole source for professional translation, interpretation, or language certification.
• Pronunciation feedback and accent training features provide approximations and may not capture all nuances of native speech.

6. Intellectual Property

• The App, including its design, code, character voices, conversation scenes, and content, is owned by Drizzling Bytes and protected by copyright and intellectual property laws.
• You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial language learning purposes.
• Custom scenes you create are yours, but we may use anonymized feedback you submit to improve the App.

7. Third-Party Services

The App relies on third-party services including OpenAI, Google, and Apple to deliver its features. These services are subject to their own terms:

We are not responsible for the availability, accuracy, or conduct of these third-party services.

8. Availability and Changes

• We may update, modify, or discontinue features of the App at any time.
• Cloud-based features require an internet connection and may be unavailable during outages or maintenance.

9. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not guarantee that:

• The App will be error-free or uninterrupted
• Generated content will be perfectly accurate
• The App will meet all your language learning needs

10. Limitation of Liability

To the maximum extent permitted by law, Drizzling Bytes shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the App. Our total liability shall not exceed the amount you paid for the App in the 12 months preceding the claim.

11. Termination

You may stop using the App at any time by uninstalling it. We reserve the right to suspend or terminate access to the App if you violate these Terms.

12. Changes to These Terms

We may update these Terms from time to time. Continued use of the App after changes constitutes acceptance of the updated Terms. We will update the "Last updated" date at the top of this page.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.
