By downloading or using ScenicSpots — New York (the “App”), you agree to these Terms of Use. If you do not agree, please do not use the App.
We grant you a personal, non-exclusive, non-transferable, revocable license to use the App on Apple devices you own or control, for your personal, non-commercial use, subject to these Terms and the Apple App Store Terms of Service. You may not copy, modify, distribute, sell, reverse-engineer, or create derivative works from the App or its content except as permitted by law. You must be the age of majority in your place of residence, or have the consent of a parent or legal guardian, to use the App and agree to these Terms.
The App offers a single non-consumable in-app purchase (“Unlock All Destinations”) that unlocks every scenic narration in New York City. Purchases are processed by Apple, are tied to your Apple ID, and can be restored on your devices via “Restore Purchases.” Billing, cancellations, and refunds are handled by Apple under the App Store Terms of Service.
The App and all of its original content — including software, user interface, and narration text and audio — are owned by Drizzling Bytes LLC and are protected by intellectual-property laws. Narration in the App is an original work created by or for Drizzling Bytes LLC (including AI-generated audio). Some photographs are used under open licenses (such as Creative Commons) from their respective rights holders; those photographs remain the property of their owners and are used under the terms of their licenses. The license above grants you no ownership of, or rights to reuse, redistribute, or commercially exploit, any App content, all of which remains owned by Drizzling Bytes LLC or its licensors.
Narration, photos, and place information are provided for entertainment and general information only. While we strive for accuracy, we do not warrant that content is complete, current, or error-free. Do not rely on the App or its audio for navigation, routing, real-time road conditions, or any safety or emergency decision — always follow official road signs, traffic laws, and a dedicated navigation app or service.
The App is provided “as is” and “as available,” without warranties of any kind, express or implied, to the fullest extent permitted by law.
To the maximum extent permitted by law, Drizzling Bytes LLC shall not be liable for any indirect, incidental, special, or consequential damages, or for any loss, injury, or damages arising from your use of — or reliance on — the App or its content, including while driving or navigating.
These Terms are governed by the laws of the State of California, United States, and applicable U.S. federal law, without regard to conflict-of-law principles. Any dispute arising from these Terms or the App will be subject to the exclusive jurisdiction of the state and federal courts located in California, except where mandatory consumer-protection law in your place of residence provides otherwise.
We may suspend or terminate your license to use the App at any time if you violate these Terms or misuse the App. You may end this agreement at any time by deleting the App. Purchases already made are governed by Apple's App Store refund policies. Provisions that by their nature should survive termination (including Intellectual Property, No Warranty, Limitation of Liability, and Governing Law) will survive.
If any provision of these Terms is held invalid or unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
We may update these Terms from time to time. Material changes will be posted on this page before taking effect, and your continued use of the App after changes constitutes acceptance of the revised Terms.
